Certifies Antitrust Class Action Against Microsoft
September 2nd, 2005
A Manhattan judge has certified a class action suit against Microsoft Corp. on
behalf of consumers who charge they were harmed by the software maker's
anti-competitive conduct.Supreme Court Justice Karla Moskowitz ruled the
plaintiffs in Cox v. Microsoft, 105193/00, had adequately shown that a
class action would be the best way to provide redress to individual consumers.

 Apple Served Three
New Class Action Suits
A new class action lawsuit, Branning et al. v. Apple Computer, Inc. alleges
that Apple is violating "California Business & Professions Code section
17200 (unfair competition) regarding a variety of purportedly unfair and
unlawful conduct including, but not limited to, allegedly selling used
computers as new, failing to honor warranties, misappropriating trade secrets
and breach of contract." Apple received the complaint on March 12, 2005 and the
following day filed a motion to transfer the case to Santa Clara County
Superior Court. Apple is investing this claim as well.

Class Action Lawsuit Filed Against Apple

A group of consumers and Apple resellers filed a class action lawsuit Thursday
accusing Apple Computer of unfair and unlawful business practices, breach of
contract, misappropriation of trade secrets, and violation of consumer warranty
laws.

 Apple Faces Class
Action Suits on IPod Battery
Apple Computer Inc. faces five class action suits filed in December claiming it
misrepresented the battery life of its iPod digital music player, the company
said on Tuesday in a regulatory filing. The Cupertino, California maker of the
Macintosh computer has been buoyed in recent quarters by robust sales of the
iPod. But users have complained the iPod battery wears out too quickly.
